Competition Terms and Conditions

1. These terms and conditions are in addition to the “Generic Toe Rag Productions Promotion
Terms & Conditions” which are available to view at www.thecafe.co.nz ;and in addition to
the One Big Switch “Terms and Conditions of use” which are available to view at
https://www.onebigswitch.co.nz/terms-and-conditions
2. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER.
3. This draw is not open to any individual who is an employee or contracted to One Big Switch,
Toe Rag Productions, Stripe Media, Stripe Productions, TVNZ, Mediaworks or a relative of a
an employee or contractor, nor any of their respective agencies, affiliates, parent
companies, or subsidiaries. One Big Switch reserves the right to require proof of eligibility, if
applicable
4. Entry into the Competition is via https://www.onebigswitch.co.nz/thecafe and completing
the official sign up to join One Big Switch New Zealand form which must be completed in
full.
5. To be entered in to the competition prize draw entry must be received from 8am 23 July and
by Midnight, Sunday 19 August, 2018.
6. The prize will be awarded through random prize draw from all eligible entrants.
7. The prize winner will be contacted by The Café and One Big Switch team and announced on
The Café show on Wednesday 22 August, 2018.
8. Entrants can enter only once using an active email address and an actual street address that
they must reside in at the time of entry.
9. Entrants must be the electricity bill payer
10. Proof of residence will be required by the winner.
11. Any entry that is incomplete, illegible, damaged, irregular, or that contains false information
is invalid.
12. Once the entrant has entered the promotion via the method described in Rule #4, the
entrant will automatically be entered into the drawing for a chance to win the following
prize: a. Free Electricity for a year, meaning one (1) year up to a maximum of $4,000.00 (NZ)
for the entire year.
13. Limit: there is one (1) prize and one (1) winner.
14. All decisions of One Big Switch are final and binding in all matters relating to this promotion.
One Big Switch will attempt to contact the winner by email as the first method of contact..
The winner must claim their prize within three (3) business days after the date of notification
of such prize. A winner’s failure to respond to the prize notification within the specified
three (3) business days will be considered such winner’s forfeiture of the prize and an
alternate winner may be selected from the pool of eligible entries. If an entrant is found to
be ineligible, an alternate winner may also be selected from the pool of eligible entries. One
Big Switch reserves the right to ship prizes directly to the email and/or mailing addresses
provided by winners during their entry of this promotion. Each entry submitted in response
to this promotion and in accordance with the Rules will constitute an official entry. Only one
(1) entry per person is permitted. Duplicate entries will be void. All entrants agree to abide
by these Official Promotion Rules. All entries become the property of One Big Switch and
Toe Rag Productions.
15. The winning entrant’s electricity account/invoice will be required to be a One Big Switch
provider and will be credited beginning September 1, 2018 and continues until September
30, 2019 OR until a maximum of $4000.00 (NZ) has been paid. If the maximum of $4,000.00
(NZ) is reached prior to September 30, 2019, then the account will no longer be credited and
the prize will be deemed fully awarded.
16. Should the winning entrant be with a non-One Big Switch provider and their current
provider requires a break fee, this will be deducted from the prize total.
17. The prize is non-transferable and has no cash value. No prize substitutions will be made. If
the winner does not use the allotted prize amount each month or at the end of the year,
there is no carry over. ie. If the bill total for the year is $2,000.00 (NZ), the winner will NOT
receive the additional $2,000.00 (NZ) in cash.
18. Should there be a dispute between with winner and One Big Switch or Toe Rag Productions
relating to the annual allotment of the prize the winner will provide or authorise One Big
Switch to access the winners last 24 months consumption data from the winners pervious
electricity retailer/s.
19. The prize is for residential homes only – Business, commercial, industrial etc are not eligible.
20. We reserve the right, in our sole discretion and at any time, to replace or amend these terms
or to modify, suspend, terminate or cancel the competition.
21. The prize is only eligible for New Zealand residents.
22. Neither One Big Switch or Toe Rag Productions, nor its associated, directors, officers,
employees, agents, representatives, successors and assigns (collectively, the “Releasees”)
are responsible for any negligence, claims, liability, injury up to and including death,
property loss or other damage to entrant, winner and/or travelling companion(s) arising
from or in connection with the acceptance, redemption or use/misuse of a prize or
participation in this promotional drawing. The winner assumes all liability for any injury or
damage caused, or claimed to be caused, by participation in this promotional drawing or use
or redemption of the prize.
23. One Big Switch or Toe Rag Productions, is not responsible for any technical problems,
malfunctions of any telephone lines, computer systems, servers, providers,
hardware/software, lost or unavailable network connections or failed, incomplete, garbled
or delayed computer transmission or any combination thereof. One Big Switch or Toe Rag
Productions, is not responsible for any liability for damage to any computer system or other
electronic device resulting from participation in or accessing or downloading information in
connection with this promotional drawing. One Big Switch or Toe Rag Productions, shall not
be responsible for entries not received or not considered eligible due to incomplete,
inaccurate, unclear or indecipherable information, failed or interrupted network
connections or other mechanical or technical problems, however caused, (including a busy
phone signal). One Big Switch or Toe Rag Productions, shall have no liability for lost, stolen,
delayed, damaged or misdirected drawing entries, or for any failure, interruption, delay,
error or omission of the One Big Switch or Toe Rag Productions, website, or any other
website(s) used during or for the purpose of participating in the promotional drawing (the
“Website(s)”) or features on the Websites during the promotional drawing, for any problems
related to the Websites or the One Big Switch or Toe Rag Productions, website, including
mechanical or technical malfunction of, or damage to, any telephone network or lines,
computer online systems, servers, access providers, computer equipment, software, for
failure of any email or drawing entry to be received by One Big Switch or Toe Rag
Productions, for any reason, for damage to an entrant’s or any other person’s computer or
other electronic device(s), or for breaches of privacy for any reason beyond the control of
PRIORITY including interference by third party computer “hackers”.
