2. Eligibility. Subject to the additional restrictions below, Castro's Epic G FUEL Giveaway!(the “Giveaway”) is open to participants who are 13 years or older at the timeof entry. (If you are between the ages of 13 to 17 years old, you will berequired to obtain consent from your legal guardian to accept any prize.)Employees of Gamma Enterprises LLC (“Sponsor”) and its affiliated companies,and advertising and promotional agencies, and the immediate family members of,and any persons domiciled with, any such employees, are not eligible to enteror to win.

No Maximum limit to entries.
Person may be credited additional entries fortweeting out a unique promotional message provided by Sponsor.
Sponsor will not be responsible for incomplete,lost, late, misdirected or illegible entries or for failure to receive entriesdue to transmission failures or technical failures of any kind, including,without limitation, malfunctioning of any network, hardware or software,whether originating with sender or Sponsor. In the event of a dispute, allonline entries will be deemed to have been submitted by the owner of the ISPaccount from which they were sent. For these purposes, an ISP account holdershall mean the natural person assigned to such ISP account by the Internetaccess provider, online service provider or other organization responsible forassigning ISP addresses for the domain associated with such ISP account. Allentries become property of Sponsor and none will be returned. Any questionsregarding the number of entries submitted or the owner of an ISP account shallbe determined by Sponsor in its sole discretion, and Sponsor reserves the rightto disqualify any entries by persons determined to be tampering with or abusingany aspect of the Giveaway.
4. Winner Selection.On the 9th of November, six (6) Winners will be selected in a random drawingfrom among all eligible entries received by that date.
5. Prizes and Odds.

6. WinnerNotification and Acceptance. Winners will be notified after eachdrawing through email. Return of prize notification asundeliverable may result in disqualification and an alternate winner may beselected from among all remaining eligible entries. Winners may waive theirright to receive prizes. Prizes are non-assignable andnontransferable. No substitutions allowed by winner. If you win, we willmake every effort to send you the flavor you requested, but we make noguarantees regarding the same. Prizes and individual components of prizepackages are subject to availability and Sponsor reserves the right tosubstitute prizes of equal or greater value. Prizes will be sent viaUnited States Postal Service or an international shipping service. If a prizeis not received by a Winner after shipment, Sponsor shall not be responsible tosend an additional / substitute prize. Winners are solely responsible forreporting and payment of any taxes on prizes. Grand Prize Winnerwill be required to complete an Affidavit of Eligibility, a General Release ofLiability and a Publicity Release (except where prohibited by law). Failureto sign and return the affidavit or release, or to comply with any term orcondition of these Official Rules, may result in a winner’s disqualification,the forfeiture of his or her interest in the prize, and the award of the prizeto a substitute winner. Except where prohibited, acceptance of any prizeconstitutes winner’s consent to the publication of his or her name,biographical information and likeness in any media for any commercial orpromotional purpose, without limitation the Internet, or further compensation. In the event that the potential Winner is underthe age of 18, the Affidavit of Eligibility, an a General Release of Liabilityand a Publicity Release a must be signed by such potential Winner’sparent/legal guardian on behalf of both the potential Winner and theparent/legal guardian and returned to Sponsor within ten (10) days ofnotification in order for the potential Winner to claim his/her prize.
7. Release. By receipt of any prize, winner agrees to release and hold harmless GammaEnterprises LLC, and its affiliate companies, suppliers, distributors, andadvertising/promotion agencies, as well as each such company’s officers,directors, employees and agents (collectively, the “Released Parties”) from andagainst any claim or cause of action, including, but not limited to, personalinjury, death, or damage to or loss of property, arising out of participationin the Giveaway or receipt, use, or misuse of any prize.
8. Publicity. Except where prohibited, participation in theGiveaway constitutes winner’s consent to Sponsor’s and its agents’ use ofwinner’s name, likeness, photograph, voice, opinions and/or hometown and statefor promotional purposes in any media, worldwide, without further payment orconsideration.
9. General Conditions. Sponsor reserves the right to cancel, suspendand/or modify the Giveaway, or any part of it, if any fraud, technical failuresor any other factor beyond Sponsor’s reasonable control impairs the integrityor proper functioning of the Giveaway, as determined by Sponsor in its solediscretion. In such event, Sponsor reserves the right to award the prizes at randomfrom among the eligible entries received up to the time of the impairment.Sponsor reserves the right, in its sole discretion, to disqualify anyindividual it finds to be tampering with the entry process or the operation ofthe Giveaway or to be acting in violation of these official rules or any otherpromotion or in an unsportsmanlike or disruptive manner. Any attempt by anyperson to deliberately undermine the legitimate operation of the Giveaway maybe a violation of criminal and civil law, and, should such an attempt be made,Main Sponsor reserves the right to seek damages from any such person to thefullest extent permitted by law. Sponsor’s failure to enforce any term of theseofficial rules shall not constitute a waiver of that provision.
10. Limitations of Liability. The Released Parties are not responsible for: (1)any incorrect or inaccurate information, whether caused by entrants, printingerrors or by any of the equipment or programming associated with or utilized inthe Giveaway; (2) technical failures of any kind, including, but not limited tomalfunctions, interruptions, or disconnections in phone lines or networkhardware or software; (3) unauthorized human intervention in any part of theentry process for the Giveaway; (4) technical or human error which may occur inthe administration of the Giveaway or the processing of entries; or (5) anyinjury or damage to persons or property which may be caused, directly orindirectly, in whole or in part, from entrant’s participation in the Giveawayor receipt or use or misuse of any prize. If for any reason an entrant's entryis confirmed to have been erroneously deleted, lost, or otherwise destroyed orcorrupted, entrant’s sole remedy is another entry in the Giveaway play,provided that if it is not possible to award another entry due todiscontinuance of the Giveaway, or any part of it, for any reason, Sponsor, atits discretion, may elect to hold a random drawing from among all eligibleentries received up to the date of discontinuance for any or all of the prizesoffered herein. No more than the stated number of prizes will be awarded. Inthe event that production, technical, seeding, programming or any other reasonscause more than stated number of prizes as set forth in these official rules tobe available and/or claimed, Sponsor reserves the right to award only thestated number of prizes by a random drawing among all legitimate, unawarded,eligible prizeclaims.
12. Participation. By participating, entrants agree to be bound bythese Official Rules and the decisions of Sponsor. Sponsor reserves theright to disqualify persons found tampering with or otherwise abusing anyaspect of this Giveaway as solely determined by Sponsor. In the event theGiveaway is compromised by a virus, non-authorized human intervention,tampering or other causes beyond the reasonable control of Sponsor whichcorrupts or impairs the administration, security, fairness or proper operationof the Giveaway, Sponsor reserves the right in its sole discretion to suspend,modify or terminate the Giveaway. Should the Giveaway be terminated priorto the stated expiration date, Sponsor reserves the right to award prizes basedon the entries received before the termination date.
13. Construction. The invalidity or unenforceability of any provisionof these rules shall not affect the validity or enforceability of any otherprovision. In the event that any such provision is determined to beinvalid or otherwise unenforceable, these rules shall be construed inaccordance with their terms as if the invalid or unenforceable provision wasnot contained therein.
14. Disputes. Except where prohibited, entrant agrees that: (1)any and all disputes, claims and causes of action arising out of or connectedwith this Giveaway or any prize awarded shall be resolved individually, withoutresort to any form of class action, and exclusively by a state or federal courtlocated in Suffolk, New York; (2) any and all claims, judgments and awardsshall be limited to actual out-of-pocket costs incurred, including costsassociated with entering this Giveaway, but in no event attorneys’ fees; and(3) under no circumstances will entrant be permitted to obtain awards for, andentrant hereby waives all rights to claim, indirect, punitive, incidental andconsequential damages and any other damages, other than for actualout-of-pocket expenses, and any and all rights to have damages multiplied orotherwise increased. All issues and questions concerning the construction,validity, interpretation and enforceability of these official rules, or therights and obligations of the entrant and Sponsor in connection with theGiveaway, shall be governed by, and construed in accordance with, the laws ofthe State of New York, without giving effect to any choice of law or conflictof law rules (whether of the State of New York or any other jurisdiction),which would cause the application of the laws of any jurisdiction other thanthe State of New York.
