2. Eligibility. Subject to the additional restrictions below, G FUEL's Twelve Days of Christmas SNES Classic Giveaway! (the “Giveaway”) is open to participants who are 13 years orolder at the time of entry. (If you are between the ages of 13 to 17 years old,you will be required to obtain consent from your legal guardian to accept any prize.)Employees of Gamma Enterprises LLC (“Sponsor”) and its affiliated companies,and advertising and promotional agencies, and the immediate family members of,and any persons domiciled with, any such employees, are not eligible to enteror to win.

In the event of adispute, all online entries will be deemed to have been submitted by the ownerof the ISP account from which they were sent. 4. Winner Selection.On January 6th, one (1) Winner will be selected in a random drawingfrom among all eligible entries received by that date.
5. Prizes and Odds.

6. WinnerNotification and Acceptance. Winners will be notified after eachdrawing through email. Return of prize notification asundeliverable may result in disqualification and an alternate winner may beselected from among all remaining eligible entries. Winners may waive theirright to receive prizes. Prizes are non-assignable andnontransferable. No substitutions allowed by winner. If you win, we willmake every effort to send you the flavor you requested, but we make noguarantees regarding the same. Prizes and individual components of prizepackages are subject to availability and Sponsor reserves the right tosubstitute prizes of equal or greater value. Prizes will be sent viaUnited States Postal Service or an international shipping service. Winners are solely responsible forreporting and payment of any taxes on prizes. In the event that thepotential Winner is under the age of 18, the Affidavit of Eligibility, an aGeneral Release of Liability and a Publicity Release a must be signed by suchpotential Winner’s parent/legal guardian on behalf of both the potential Winnerand the parent/legal guardian and returned to Sponsor within ten (10) days ofnotification in order for the potential Winner to claim his/her prize.
7. Release. By receipt of any prize, winner agrees to release and hold harmless GammaEnterprises LLC, and its affiliate companies, suppliers, distributors, andadvertising/promotion agencies, as well as each such company’s officers,directors, employees and agents (collectively, the “Released Parties”) from andagainst any claim or cause of action, including, but not limited to, personalinjury, death, or damage to or loss of property, arising out of participationin the Giveaway or receipt, use, or misuse of any prize.
8. Publicity. Except where prohibited, participationin the Giveaway constitutes winner’s consent to Sponsor’s and its agents’ useof winner’s name, likeness, photograph, voice, opinions and/or hometown andstate for promotional purposes in any media, worldwide, without further paymentor consideration.
9. General Conditions. Sponsor reserves the right to cancel,suspend and/or modify the Giveaway, or any part of it, if any fraud, technicalfailures or any other factor beyond Sponsor’s reasonable control impairs theintegrity or proper functioning of the Giveaway, as determined by Sponsor inits sole discretion. In such event, Sponsor reserves the right to award theprizes at random from among the eligible entries received up to the time of theimpairment. Sponsor reserves the right, in its sole discretion, to disqualifyany individual it finds to be tampering with the entry process or the operationof the Giveaway or to be acting in violation of these official rules or anyother promotion or in an unsportsmanlike or disruptive manner. Any attempt byany person to deliberately undermine the legitimate operation of the Giveawaymay be a violation of criminal and civil law, and, should such an attempt bemade, Main Sponsor reserves the right to seek damages from any such person tothe fullest extent permitted by law. Sponsor’s failure to enforce any term ofthese official rules shall not constitute a waiver of that provision.
10. Limitations of Liability. The Released Parties are not responsiblefor: (1) any incorrect or inaccurate information, whether caused by entrants,printing errors or by any of the equipment or programming associated with orutilized in the Giveaway; (2) technical failures of any kind, including, butnot limited to malfunctions, interruptions, or disconnections in phone lines ornetwork hardware or software; (3) unauthorized human intervention in any partof the entry process or the Giveaway; (4) technical or human error which mayoccur in the administration of the Giveaway or the processing of entries; or(5) any injury or damage to persons or property which may be caused, directlyor indirectly, in whole or in part, from entrant’s participation in theGiveaway or receipt or use or misuse of any prize. If for any reason anentrant's entry is confirmed to have been erroneously deleted, lost, orotherwise destroyed or corrupted, entrant’s sole remedy is another entry in theGiveaway play, provided that if it is not possible to award another entry dueto discontinuance of the Giveaway, or any part of it, for any reason, Sponsor,at its discretion, may elect to hold a random drawing from among all eligibleentries received up to the date of discontinuance for any or all of the prizesoffered herein. No more than the stated number of prizes will be awarded. Inthe event that production, technical, seeding, programming or any other reasonscause more than stated number of prizes as set forth in these official rules tobe available and/or claimed, Sponsor reserves the right to award only thestated number of prizes by a random drawing among all legitimate, unawarded,eligible prize claims.
12. Participation. By participating, entrants agree to bebound by these Official Rules and the decisions of Sponsor. Should theGiveaway be terminated prior to the stated expiration date, Sponsor reservesthe right to award prizes based on the entries received before the terminationdate.
13. Construction. The invalidity or unenforceability ofany provision of these rules shall not affect the validity or enforceability ofany other provision. In the event that any such provision is determinedto be invalid or otherwise unenforceable, these rules shall be construed inaccordance with their terms as if the invalid or unenforceable provision wasnot contained therein.
14. Disputes. Except where prohibited, entrant agreesthat: (1) any and all disputes, claims and causes of action arising out of orconnected with this Giveaway or any prize awarded shall be resolvedindividually, without resort to any form of class action, and exclusively by astate or federal court located in Suffolk, New York; (2) any and all claims,judgments and awards shall be limited to actual out-of-pocket costs incurred,including costs associated with entering this Giveaway, but in no eventattorneys’ fees; and (3) under no circumstances will entrant be permitted toobtain awards for, and entrant hereby waives all rights to claim, indirect,punitive, incidental and consequential damages and any other damages, otherthan for actual out-of-pocket expenses, and any and all rights to have damagesmultiplied or otherwise increased.
